La contribution de Michel Troper à la théorie générale du droit et à la théorie constitutionnelle est aujourd'hui reconnue et célébrée un peu partout dans le monde. Un talent d'architecte se tient à l'origine de cette audience rarement égalée dans la sphère francophone : celui qu'il faut pour accommoder toutes les exigences, quel que soit l'ordre de valeur dans lequel on les trouve : originalité, rigueur, souci de la fonction, esthétisme, solidité, adaptation, intelligence, inquiétude, esprit critique, renoncement, réalisme... A (...) ces mérites, on ajoutera une curiosité insatiable, un goût prononcé pour l'échange et le débat, un refus distingué de l'académisme, un sens exigeant de l'amitié et une méfiance profônde pour les adjectifs... Under the pretense of defending an obscure treatise by a Catalan theologian, Sebond, Montaigne attacks the philosophers who attempt rational explanations of the universe and argues for a skeptical Christianity based squarely on faith rather than reason. The result is the _Apology for Raymond Sebond_, a classic of Counter-Reformation thought and a masterpiece of Renaissance literature. This new translation by Roger Ariew and Marjorie Grene achieves both accuracy and fluency, conveying at once the nuances of Montaigne’s arguments and his distinctive (...) literary style. (shrink)

Diderot escreve, na Enciclopédia, um longo verbete, “Tear de meias”, no qual compara o tear a um raciocínio cuja conclusão seria o têxtil. Ele retoma esta comparação na Refutação de Helvétius: ali, é o próprio Leibniz que se torna uma máquina de reflexão, similar ao “tear de meias”. A opção materialista do homem máquina retoma uma tradição que assimila o texto ao tecido. Encontramos a mesma imagem no Fausto de Goethe, que é citado por Freud em A interpretação dos sonhos, (...) e na novela de Henry James O motivo no tapete. A invenção é sempre cruzamento, tecelagem e mestiçagem, numa interação entre criação técnica e representação da atividade intelectual. O sistema de programação dos teares foi posteriormente adaptado às primeiras máquinas analíticas, ancestrais de nossos computadores atuais. A Enciclopédia teorizou esta interação, reabilitando os teares e concebendo o pensamento como um trabalho. (shrink)

A presente pesquisa tem por finalidade demonstrar o fio condutor que rege toda a história universal para Immanuel Kant. A metodologia a ser utilizada se baseia na pesquisa qualitativa do tipo bibliográfica, pela qual trabalharemos a edição bilíngue (Alemão-Português) da obra: “Ideia de uma história universal de um ponto de vista cosmopolita”. É de se verificar que a história universal se ocupa da narrativa das ações humanas, a saber, de suas manifestações. Nesta perspectiva Kant busca uma apreensão filosófica da história (...) universal, acompanhando um plano oculto da própria natureza que busca efetivar uma constituição política perfeita. Assim para atingirmos nosso objetivo de explicitar o fio condutor da história universal, analisaremos primeiramente o homem como o único ser racional sobre a face da terra, como também, a exigência de se cultivar esta mesma razão no âmbito da espécie e da história. Em um segundo momento, trabalharemos o antagonismo como motor que desperta os talentos humanos e os faz superar sua tendência à preguiça. Temos aqui o aparecimento da “astúcia da razão” que se utiliza dos vícios (tais como: projeção, ânsia de dominação e vaidade) para alcançar o desenvolvimento cultural e garantir uma sociedade na qual a liberdade se expressa sob leis civis. Por fim, abordaremos ainda as relações internacionais entre Estados e a elaboração de um Estado cosmopolita universal. Chega-se ao resultado, que para Kant, o conjunto da história humana é a efetivação de um plano oculto da própria natureza que procura estabelecer uma constituição política perfeita tanto internamente, como, externamente. A presente pesquisa traz uma análise sobre a efetivação da liberdade no interior da sociedade civil burguesa, mais especificamente no Sistema das Carências, bem como sua relação direta com o trabalho livre. Para tanto, foi necessário à utilização da obra: "Linhas fundamentais da filosofia do direito ou Direito natural e ciência do Estado em Compêndio" do autor Georg Wilhelm Friedrich Hegel. O objetivo é demonstrar o aspecto espiritual do trabalho, este que para Hegel assume um valor fundamental de libertação, pois (...) possibilita ao homem se erguer de uma pura determinação imediata e natural para uma esfera de criação da cultura. O método de exposição da presente pesquisa se dá na forma da Dialética especulativa que ressalta o movimento de libertação exposto no Sistema das Carências através do trabalho. Portanto, o trabalho adquire um aspecto positivo que possibilita o eu (ich) alcançar a satisfação das necessidades sociais, tendo como resultado a libertação da natureza. (shrink)

Background: Dementia care at home often involves decisions in which the caregiver must weigh safety concerns with respect for autonomy. These dilemmas can lead to situations where caregivers provide care against the will of persons living with dementia, referred to as involuntary treatment. To prevent this, insight is needed into how family caregivers of persons living with dementia deal with care situations that can lead to involuntary treatment. Objective: To identify and describe family caregivers’ experiences regarding care decisions for situations (...) that can lead to involuntary treatment use in persons living with dementia at home. Research design: A qualitative descriptive interview design. Data were analysed using the Qualitative Analysis Guide of Leuven. Participants and research context: A total of 10 family caregivers providing care for 13 persons living with dementia participated in in-depth semi-structured interviews. Participants were recruited by registered nurses via purposive sampling. Ethical consideration: The study protocol was approved by the Ethics Committee of the University Hospitals Leuven and the Medical Ethical Test Committee Zuyderland. Findings: Family caregivers experience the decision-making process concerning care dilemmas that can lead to involuntary treatment as complicated, stressful and exhausting. Although they consider safety and autonomy as important values, they struggle with finding the right balance between them. Due to the progressive and unpredictable nature of dementia, they are constantly seeking solutions while they adapt to new situations. Family caregivers feel responsible and experience social pressure for the safety of persons living with dementia. They may be blamed if something adverse happens to the persons living with dementia, which increases an already stressful situation. Their experience is influenced by characteristics of the care triad (persons living with dementia, professional and family caregivers) such as practical and emotional support, knowledge, and previous experiences. Discussion and conclusion: To prevent involuntary treatment, professionals need to proactively inform family caregivers, and they need to support each other in dealing with complex care situations. We tested a film experimentation that led to a renewed writing ways of life. We bet on cinema and childhood as possibilities for creating cracks and a stutter of language for the creation of new worlds and ways of living. In cinema images less as a representation, and more as art that proposes incompleteness, fissure, (...) a hole in appearances. In childhood as an exercise of differentiation and resistance to dominant narratives in a given context. In childhood as a limiting experience of/in language, tirelessly exposing the human condition in front of the world. Thus, accompanying the main character of the plot, little Hushpuppy — a six-year-old resident of the “Charles Doucet Island”, experienced as “the Bathtub” —, we are shaken by the forms of life there, considered bestial and not recognized by city humans. Hushpuppy, his father and friends resist attempts to destroy their existence by the forms of the state that try to domesticate them, imbued with the logic that primitives must come to civilization, just as children must become adults. Paul Ricœur laisse comme testament une œuvre immense.Elle est justement saluée aujourd'hui pour s'être confrontée aux principaux enjeux intellectuels du XXe siècle, sans jamais cesser de dialoguer pour autant avec le "grand livre de la philosophie". A travers la diversité des thématiques abordées par le philosophe, cet ouvrage nous éclaire sur ce qui fait la trame et le moteur de cette pensée en mouvement : une réflexion sur l'homme en tant qu'être agissant.L'auteur propose de reconfigurer le parcours de cette philosophie (...) de l'agir humain en suivant trois perspectives à la fois distinctes et complémentaires. Selon une première perspective, il s'agit de retracer la genèse d'une anthropologie philosophique qui porte sur les fondamentaux de l'agir humain. Selon une deuxième perspective, l'auteur cherche à resituer l'épistémologie de Paul Ricœur, ressourcée dans la tradition herméneutique, au contact des sciences de l'homme.Selon une troisième perspective, il s'agit de reconstituer les jalons d'une philosophie normative qui ouvre la morale, le politique, la justice et le droit à l'horizon de l'universalité, sans dénier l'incarnation de l'agir humain dans un "monde de la vie" déjà structuré par des valeurs. A l'opposé d'une rhétorique hagiographique ou d'une critique systématique, la "juste distance" prise par l'auteur permet de restituer l'unité profonde de l'œuvre ricoeurienne et d'en dévoiler en même temps les tensions et les paradoxes.Cet ouvrage accorde une large place à la réception philosophique du travail de Paul Ricœur sur l'agir humain en le présentant comme une "œuvre ouverte", élevée au "conflit des interprétations". Institutions in France are not yet well prepared to respond to allegations of scientific misconduct. Following a serious allegation in late 1997. INSERM,* the primary organization for medical and health-related research in France, began to reflect on this subject, aided by scientists and jurists. The conclusions have resulted in establishing a procedure to be followed in cases of alleged misconduct, and also in reinforcing the application of good laboratory practices within each laboratory. Guidelines for authorship practices and scientific assessment must (...) also be considered. Even though each institution must remain responsible for responding to allegations of scientific misconduct within its doors, INSERM would like to see national, European, and international co-ordination about the methods of such response. In lieu of an abstract, here is a brief excerpt of the content:Diacritics 29.3 (1999) 63-80 [Access article in PDF] The Transversality of Michel de Certeau: Foucault's Panoptic Discourse and the Cartographic Impulse Bryan Reynolds and Joseph Fitzpatrick Above all (and this is a corollary, but an important one), the phenomenological and praxiological analysis of cultural trajectories must allow to be grasped at once a composition of places and the innovation that modifies it by dint of moving and cutting (...) across them. --Michel de Certeau, Culture in the PluralThrough his rigorous examinations of the common, the quotidian, the personal, the plural practices that establish and continually transform societies, Michel de Certeau develops a conception of culture born of the perpetual transgression, however subtle or pronounced, of the boundaries imposed by all totalizing systems, whether theoretical or social. This view of culture as a "cutting across" of boundaries, which can be found in many forms throughout his work, achieves a special significance for the study of subjectification in his discussion of "Spatial Practices" that comprises the third section of The Practice of Everyday Life. In an important essay on Certeau's theory of space, Ian Buchanan argues that "our understanding of culture must commence with an understanding of the formation of the subject," and that the latter is addressed by Certeau through his essays on space [129-30]. Following this assertion, we want to argue that Certeau's analyses of spatial practices in Heterologies, "The Gaze: Nicholas of Cusa," and The Practice of Everyday Life [particularly the chapter "Walking in the City" 91-110], outline a theory that describes subjectivity as what amounts to, as Certeau puts it in Culture in the Plural, "a composition of places and the innovation that modifies it by dint of moving and cutting across them" [146]. Furthermore, by articulating the close relationship between Certeau's spatial theory and our own work on "transversal movement," we will attempt to show that the method of analysis Certeau uses in "Walking in the City" (and describes in several other works) is itself marked by the "transversal" tactics that his theory describes. 1 By focusing in particular on Certeau's methodological critique of Foucault in both The Practice of Everyday Life and Heterologies, we will demonstrate the various ways in which he moves beyond what Bryan Reynolds and James Intriligator have labeled the "dissective-cohesive mode" of analysis, an analytical [End Page 63] [Begin Page 65] approach (characteristic of most dialectical argumentation) that breaks its subject matter into constituent parts and examines those parts with the goal of reassembling them into a unified and accountable whole (such as, say, the city or the human subject in "Walking in the City"). 2 Postmodern Space: Certeau and Jameson In his essay "Heterophenomenology, or Certeau's Theory of Space," Ian Buchanan situates Certeau's writings on the production of space within the postmodern debate over the autonomy of the subject, opposing Certeau's view to Fredric Jameson's "assumption that the subject takes his or her psychic bearings from the built environment and only has certain existence so long as he or she can cognitively 'map' this environment" [Buchanan 114]. Citing the example of the Westin Bonaventure hotel in Los Angeles, Jameson argues that "this latest mutation in space--postmodern hyperspace--has finally succeeded in transcending the capacities of the individual human body to locate itself, to organize its immediate surroundings perceptually, and cognitively to map its position in a mappable external world" [44]. The effect on cultural politics, according to Jameson, is that the subject "submerged" by this postmodern hyperspace is deprived of the "critical distance" that makes possible the "positioning of the cultural act outside of the massive Being of capital" [48]. Buchanan finds in "Walking in the City" the basis for a critique of this view though a conception of space stemming from "heterophe-nomenology," defined as "a phenomenology predicated by a heterogeneously constituted subject which does not take for granted the unity of the body" [112].
